Terms of service

Article 1 — Purpose and scope

These terms of sale govern the contractual relationship between Maison Sfifa (hereinafter "the Seller") and any person making a purchase on the website (hereinafter "the Customer"). They apply to all sales concluded on the website and prevail over any other document. Placing an order implies unreserved acceptance of these terms.

Article 2 — Products

The products offered are those shown on the website at the time of viewing, subject to availability. As each piece is partly handmade, slight variations in shade, finish or placement of the trim may occur from one piece to another. These variations are inherent to the artisanal nature of the products and do not constitute a defect. Photographs are as accurate as possible but cannot guarantee an exact match with the product.

Article 3 — Prices

Prices are shown in euros, inclusive of all taxes, excluding shipping costs, which are charged separately and shown before the order is confirmed, and excluding customs duties or any other duties and taxes related to the importation of the products into the Customer's country. Maison Sfifa reserves the right to change its prices at any time; products are invoiced on the basis of the rates in force when the order is placed.

Article 4 — Orders

The Customer selects the products, reviews the basket, enters their delivery details, chooses a payment method and definitively confirms the order. Confirmation of the order constitutes conclusion of the contract. A confirmation e-mail summarising the order is sent to the Customer. Maison Sfifa reserves the right to refuse or cancel any order for legitimate reasons, in particular a previous dispute or an abnormal order.

Article 5 — Payment

Payment is made online using the methods offered on the website:

  • Bank card
  • Apple Pay
  • Google Pay
  • PayPal
  • Samsung Pay

The transaction is secured by Shopify Payments / Stripe. The order is only definitively recorded once payment is confirmed. Maison Sfifa stores no banking data.

Article 6 — Delivery

Delivery terms, zones and timeframes are detailed in the Shipping Policy, which forms an integral part of these terms.

Article 7 — Right of withdrawal

The Customer has a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal, without having to give a reason. The terms are detailed in the Returns Policy. Consumers residing in the European Union enjoy this right in full, under the mandatory protections applicable to them.

Exception. The right of withdrawal does not apply to goods made to measure or clearly personalised. Made-to-measure pieces (bespoke service) are therefore neither returnable nor refundable, except in the case of a fault.

The right of withdrawal may only be exercised for products returned complete, in perfect condition, unworn, clean, sealed, in their original packaging. Products returned incomplete, washed, perfumed, cleaned, damaged, soiled, unsealed, broken or damaged in any way whatsoever will not be taken back, exchanged or refunded.

The parcel must be returned to the address indicated in the return procedure, in its original packaging. It is the Customer's responsibility to keep the proof of postage provided by the carrier, the proof of postage serving as evidence of the return date. As the return is at the Customer's expense, no refund can be issued if the parcel is lost.

All sums paid (excluding shipping costs) will be refunded to the Customer no later than fourteen (14) days following the date on which the Seller receives the Customer's withdrawal form.

The risks and costs of return are borne solely by the Customer.

Returns from outside the European Union

For any order shipped to a country outside the European Union, returns are subject to the following contractual conditions:

The Customer remains solely responsible for all costs related to the return, including in particular:

  • Return shipping costs
  • Customs duties
  • Import VAT
  • Customs clearance or administrative fees charged by the carrier or the competent authorities

In the event that any duties, taxes or fees are charged to Maison Sfifa as a result of an inaccurate or incomplete declaration made by the Customer, these amounts will be deducted in full from any refund due.

No refund can be made before the actual receipt of the product and the settlement of all costs related to the return.

Article 8 — Conformity and guarantees

The Seller undertakes to deliver products conforming to their description. In the event of a non-conforming or defective product, the Customer may obtain the repair, replacement or refund of the product. Consumers residing in the European Union additionally enjoy the mandatory legal guarantees applicable to them.

Article 9 — Liability

Maison Sfifa cannot be held liable for non-performance of the contract in the event of force majeure, disruption or strike affecting transport services, or any act attributable to the Customer or a third party. The Seller's liability is limited to the amount of the order.

Article 10 — Governing law and disputes

These terms of sale are governed by the law of the United Arab Emirates. In the event of any difficulty, the Customer is invited to contact Maison Sfifa in order to seek an amicable solution as a priority. Failing agreement, the competent courts of the United Arab Emirates shall have sole jurisdiction, without prejudice to the mandatory protections enjoyed by consumers residing in the European Union.
